2.5L models only have Drive and Low mode- no manual transmission controls
All 2.5 model CVTs have L-D transmission control. L is Low mode, and is the only option other than Drive. There is no manual control available on 2.5 models, and is the first Forester without it. It means the driver can't control or get more power when needed for passing on hills or 2 lane roads, or for towing a trailer, driving on camping or snowy roads etc. All previous year Foresters have had controllable transmissions for safety and performance. If you think Subaru should put Paddle Shifters with manual control back on the 2.5 model, please voice your concern to Subaru's customer support at 800 SUBARU3 (800 782-2783)

2014 forester 2.0 XT CVT transmission has Drive and Manual modes
2.0 XT  CVTs have M-D for Manual and Drive modes, giving the driver the option of full transmission control for those times when more power is needed, or more control for snowy or logging roads. It is used with the standard Paddle Shifters. This very important safety feature is on  XT models only, and not available on 2.5 models at all.

new for 2014 Here's the approach light on during the day because a door is open. Its a small but bright LED that's on when a door is opened or unlocked with the remote. It even actually has a small Subaru logo on the glass.
The outside mirrors also automatically darken when the bright lights from a following car hits the auto dimming rear view mirror. The dimming function of the outside side view mirrors is activated by the rear view mirror.

ALL NEW FOR SUBARU the entire center is dark! This a really nice option for those of us who don't like bright lights in their eyes at night, and is a first for Subaru. NEWS AND UPDATES

NEW 6/1/16- a new remote start is now available with full long distance range on pushbutton start models. It does use a 2nd remote start fob. Part #H001SAL100

4/7 the new optional rear seatback protector available on the 2015 models does fit the 14s.

2/26 2015 Forester specs and prices released.
new- base 2.5i  gets rear view camera and color multi-function display like the 14 Premiums with fuel economy gauges, maintenance reminders etc
new- base 2.5i CVT has optional alloy wheel and roof rail package.
new- 2.5i Premium manual gets moonroof
new- 2.5i  Touring and 2.0XT Touring loses navigation but gets keyless access with pushbutton start, HID low beams, chrome rocker panel trim, and 18" alloys
new- 2.0XT premium gets the All Weather Pkg
new- optional Eyesight is now available on 2.5 Premium, Limited and Touring models

The good changes
- roof rails available on the base model CVT with #02 pkg
- backup camera standard on the base model, so it's now on all models
- 2.0XT Premium gets the all weather package.
- Touring models lose the navigation system (its now optional), and instead get standard pushbutton start and HID low beams.

Things I wish they had changed on the 2015s but didn't..
- added Paddle Shifters. It didn't happen.
- fixed the very problematical power rear gate mechanism. It didn't happen. Only available on the Limited and Touring models, the overly complicated rear gate needs 4 pages of instructions in the owner's manual (!?), plus its slow to open and tugging on it makes it not open correctly.
- 2nd generation Eyesight. Doesn't seem to have made it to the 2015 Forester

2015 Forester MSRP prices including $850 destination (to Ak $1000)
2.5i manual -$23045
2.5i CVT- $24,045; with 17" alloys and roof rails $24,645
2.5i Premium manual with all weather pkg- $25,445
2.5i Premium CVT $25, 945; with all weather pkg $26,495; with AWP and Eyesight $26,790; with AWP, Eyesight, Nav $28340
2.5i Limited $28,095; with Nav and Harman Kardon audio $30,795; Nav, Harman Kardon audio and Eyesight $31,590
2.5i Touring 430,945; with Eyesight and Nav $32,840
2.0XT Premium $29,345
2.0XT Touring $33,956; with Eyesight and Nav $35,851

1/26 What it would be good to see on the 2015 model.
My Top 10 2015 Forester Wish list

#1 Paddle shifters on the 2.5s. It would change the ability of the car for those who know how to use it. But its unlikely that it will be added, so buy a Forester 2.0XT or an Outback instead.
#2 a simple knob by the driver's knee to open/close the power gate and and set the gate's memory height, to replace the current ridiculously complex  two button system that requires 4 pages of instructions in the manual. A simple knob with off, low, medium and high memory height settings would be fine, with a center pushbutton to open.
#3 passenger seat. make the passenger seat height adjustable with lumbar support. Manual on 2.5, Premium, and power on Limited, Touring
#4 improve the handsfree phone functions and clarity. It should download contacts and sound better ... it works ok but everyone sounds just terrible.
#5 All weather package and fog lights standard on XT Premium
#6 2nd generation Eyesight standard on Touring, optional on Limited and Premium
#7 backup camera and roof rails on 2.5 base model
#8 upgrade the navigation completely, or at least start with much better screen resolution, a cleaner, less busy/fussy screen with bigger buttons, better voice controls (they barely work), and improve the text messaging capability (it also barely works)
#9 Limited model gets standard keyless access with pushbutton start (included on Premium with eyesight and navigation), power passenger seat,
#10 Touring model gets power memory seat, remote engine start, power passenger seat, more sound insulation

12/4 Forester orders cut off on 12/5!
This is really early. It means production is filled through the end of the 14 model run (March)  and Subaru doesn't want new special orders entering the system.
2015 orders will be available in March (no changes announced yet)

11/16 2014 Forester navigation SD update on Forester built before June 20, 2013
Available on 2014 Foresters with navigation built before June 20, 2013 - check the VIN plate on the driver's door jam - there's a free SD card update. Make an appointment with your dealer service dept. It's service bulletin 15-166-13R Customer Satisfaction Navigation SD card Update Program for 2014 Forester, and the SD card will need to be ordered. Changes include earlier turning directions,  various screen updates with font, menu, and cancel trip buttons etc, and improved navigation, audio, and phone automatic muting functions. Again, its only on 2014 Foresters built prior to June 20, 2013

10/10/13 Congratulations to Subaru!
Forester is Motor Trend's SUV of the Year

Subaru has a knack for making the right size vehicles for the marketplace, with just the right level of capability people want. As the SUV landscape has changed and traditional body-on-frame SUVs have been overtaken by unibody crossovers and sport/utes, Subaru has changed as well. It moved from selling smaller wagons to making unibody crossovers, and these vehicles resonate with buyers. The company's Forester and Outback have gotten larger over time, but not so large that they scare off loyal Subaru fans. Subarus aren't over the top or ostentatious; they're honest and smart. The redesigned 2014 Subaru Forester has better efficiency, added power, and increased cargo volume, without a significant increase in overall size. The new Forester provides a comfortable ride with a roomy interior. Its off-road capability is plenty for the majority of sport/utility buyers. It offers a lot of value for the money. And it accomplishes all this while still being fun to drive.
Motor Trend SUV of the year competition,
Subaru provided two models on opposite ends of the spectrum: the 2.5i Premium with a six-speed manual and the turbocharged 2.0XT with a continuously variable transmission. The base 2.5-liter four returns for 2014, now with a six-speed manual instead of a five, and its fuel economy has improved. The 2.0XT is powered by a new turbo flat-4 engine, with 26 more horsepower, 32 lb-ft more torque (available at a lower rpm), backed by a CVT instead of the four-speed automatic in the previous generation. Its fuel economy also improved for 2014.
of note is that Motor Trend didn't test the model people will purchase, which is the 2.5 with CVT.

5/15/13  safety- one more reason to buy a Forester...
the 2014 Forester gets top crash test rating from the IIHS in all five tests-
Front moderate overlap, Side, Rollover, Rear and the new Front small overlap.
The IIHS rates vehicles as Good, Acceptable,  Marginal, and Poor.
Of the vehicles tested in all 5 crashes, Front moderate overlap, Side, Rollover, Rear and the new Front small overlap, only the 2014 Subaru Forester was rated Good in all tests.
The 2nd best rated was the Mitsubishi Outlander with Good on all except the Front small overlap with a rating of Acceptable.
BMW X1, Honda CR-V, Mazda CX5, VW Tiguan, Buick Encore, Ford Escape, Hyundai Tucson, Jeep Patriot, Kia Sportage all were also rated Good on all except the Front small overlap but they all received a lower safety rating of Marginal. The Nissan Rogue received a good rating in 3 or 5 test, Acceptable in the rollover test, and Marginal in the Front small overlap test.
Be sure to check out the
IIHS press release with video of the crash test.

5/10/13 more on the recalled carpeted floor mats

Subaru is looking for a new supplier and the 2014 Forester replacement carpeted floor mats should be available in June. In the meantime, rubber floor mats are now available.

4/25/13  the Forester floor mats are now an official recall.
Due to improper material used in the backing on the carpeted floor mats included with all models, the mats can curl when exposed to heat, possibly interfering with the gas, brake or clutch pedals. This affects all 2014 Foresters sold before 4/22/13. Owners will be notified. Replacement mats will be provided when available starting May 2013. Rubber mats are now available for purchase from Subaru dealers. Recall #WQH-44

4/23 Forester replacement carpeted floor mats expected in early May.

4/16 2014 Forester carpeted floor mats that are included with the car are on hold.
You can buy a new Forester but the carpeted mats that come with the car should be removed, they should not be in the car. Replacement carpeted mats will be available, no date announced. No specific reason has been offered other than Subaru 'has detected a potential quality problem with carpeted floor mats'. and they might not lie flat. Rubber floor mats are now available.

4/10 2014 Forester brochures now at dealers. 29pgs

4/6/13 More accessories  available- rubber floor mats $72,  moonroof air deflector $122, upgraded speakers by Kicker $333, and a 'Protection Package' which is optional cargo cover, rear bumper cover, seatback cargo net, rubber mats, and splash guards (options are also available at the same price individually)

12/4/12  More on the 2.5L CVT and paddle shifters.
The Subaru 2014 Forester site under 'specs' indicates that the 2.5L CVT has Paddle Shifters. Hopefully the 2.5L will have them, but the photos of the Limited at the LA auto show (see above) clearly shows the shifter with 'low mode' and no Paddle Shifters.
If you think Subaru should put Paddle Shifters with manual control back on the 2.5 model, please voice your concern to Subaru customer support at 800 SUBARU3 ((800 782-2783)

12/1/12 this webpage updated with photos, and specs on the 2014s
The car is expected in the U.S. March 2013, with orders in early February.

10/31/12 This is early 2014 Forester information.

The car will be shown at the LA auto show 11/30-12/9 and a lot more information will be available then, including if the 2014 still has the great rear visibility that the current model has. Hopefully it does.
It will be for sale in Japan November 12, 2012
The cars are expected to arrive in the US winter 2013.
The Forester has been a consistent top seller for Subaru and this is a this is a major and long awaited redesign.  Its a little bigger and will get better fuel economy. The bottom line for most people? If they liked it before they'll like it now-  the changes are more evolution than revolution. And if it's too big, there's always the new Crosstrek
The new US Forester will use the same 2.5L engine with 170hp used in the current 2.5X models. That's a relief for all the people worried the US models would get a 2.0L with only 148hp.  A CVT replaces the dated 4 speed automatic Sportshift currently in all models, which will increase fuel economy and could encourage some buyers to wait for the 14s.
The turbo performance models get an strong new turbo 2.0L direct injection engine with 250hp and and all new high-torque CVT.  The increased power is going to please enthusiasts and car reviewers while the CVT will leave them asking for a 6 speed manual and optional 7 or 8 speed automatic. Premium gas is recommended but no looner required. This all new 2.0L turbo is the first of the new turbos to come in future BRZ, WRX, and STI turbos.
The new Forester is slightly longer, wider and taller than the 2013s, but not much. The overall length grows by 1.4" and the wheelbase by .9". Its expected the rear seats will benefit the most.
The 2014 Forester will stand at 68.2" high, or 1.3" higher than the the 2013 and 2.40" higher than the Outback's 65.8" height. Thats in keeping with the competition.
If you like the current size, the 2014 will not disappoint, though the increased height will make putting accessories on the roof harder and if its too high, again there's always the Crosstrek.
Harman Kardon and probably Aha will be available.

WHAT'S NEW ON THE 2014 FORESTER

The 2014 Forester is all new.... new body, new 2.0L turbo engine for the XT model (the 2.5L is the same), new 6 speed manual, new CVT (X model) and high torque CVT (XT model) transmissions, new interior, wheels, stereo...
This is the 4th generation Forester. The first Forester was the 1998 model in 1997.

Big Changes
a brief summary of new features highlights
more details will be added here as available.

The car is expected in the US March 2013, with orders in early February.

BODY

new its slightly bigger, longer, wider, taller
new more rear seat and cargo room
new wheelbase is 103.9" (.9" longer than the previous models) which means more room.
new overall length is 180.9" which is 1.4" larger than the 2013's 179.5". For comparison, a 2013 Outback is 189.0"
new overall height is 68.2". The 2013 Forester was 66.9". For comparison an Outback is 65.8"

FEATURES
new Back-up rear view camera standard on models except base 2.5i
new Power rear gate standard on Limited and Touring models. Note The power gate height settings are way overly complicated, requiring 4 pages in the owners manual (yes, 4 pages!). There really just needs to be a simple knob with low, medium and high settings and hopefully Subaru will correct this next year.
new Driver Assist Technology Package with new to the Forester Eyesight active cruise control, new Pushbutton start proximity key, and HID headlights
new Color display with back-up camera display, fuel economy readings, outside temperature, audio and bluetooth info, climate control info, vehicle self-check and maintenance reminder, and on Limited, Touring models X-mode and hill descent info.
new Stereos- HD now standard on all except base 2.5i models. Touring models get a new standard Harman/Kardon 440watt amp with 8 H/K speakers, Navigation/GPS with Aha connectivity

MECHANICAL
new CVT transmissions.
2.5 X models: The city/highway MPG rating is 24/32. That's a giant and long needed improvement over the 22/27mpg of previous versions (4 speed automatic).
This is the same CVT used in the 2013 Outback, Legacy, Impreza, and Crosstrek.
Important note: the CVT transmission on X models does not have paddle shifters. The only transmission control on the 2.5 CVT is 'low mode' for driving slowly in snow.
2.0XT models: all new high-torque CVT with new 6 and 8 speed Paddle Shifters. The driver controllable SI drive setting determines whether the transmission shifts with 6 or 8 speeds (8 in the sportier S# mode).
new Electric power steering- less drag on the engine

new XT model- this is an all new performance model with all new 2.0L 250hp engine with all new high-torque CVT with new 6 and 8 speed Paddle Shifters (depends on SI drive setting). The suspension is stiffer and brakes larger than on 2.5i models. SI-drive is standard for driver controlled throttle response and determines if the CVT acts with 6 or 8 speeds in manual mode. SI-drive has been available on other models including the STI.
new All Wheel Drive control: 'X-mode with Hill descent control' is standard on 2.5i Limited, Touring, XT Premium and Touring models. This is the first new improvement to Subarus very capable AWD system.  X-mode with hill descent control is activated by the driver and is a fully computerized system that controls the engine, CVT transmission, AWD system, brakes, and VDC/traction control to help maintain control on slippery surfaces or steep hills.  Hill descent control is activated with X-mode and uses VDC engine throttle management and brakes to help control vehicle speed when going downhill.
new Suspension upgraded- retuned front and rear suspension.

SAFETY
new Anti-whiplash front seats
new Impact sensing fuel cutoff
new Drivers knee airbag now standard, for a total of 7 airbags
new Brake override system- stop car when both brake and gas pedals are pressed

COLORS
click for the color table
new Ice Silver now available on X models in either off black or platinum cloth or leather.  All XTs are off-black
new Black now with the off-black interior
new Burnished Bronze
new Jasmine Green
new to Forester Venetian Red

Gone and no longer available
Passenger seat is no longer height adjustable

COMMENTS,  OBSERVATIONS
This is a long awaited update to the Forester.
From the looks of the body, the new 2014s maintains the great utility of previous models, while adding some much needed improvements with the X model's CVT transmission and XT's new more powerful 250hp 2.0L turbo.
Hopefully Subaru will finally have a standard 100,000 power train warranty. Or at least offer a 10year/100,000 mile extended warranty.

More comments in the future...

WHAT?? Whoa....
The 2.5i CVT does not have Paddle Shifters or any way to control the transmission other than 'low mode'.
Low mode is basically like 2nd gear.
Previous Foresters have had +/- gear selectable Sportshift 4 speed transmission, and all other CVTs, in the Outback, Legacy, Crosstrek, and Impreza (except 2.0 base model) have Paddle Shifters with 6 gear-like settings with sequential +/- gear control. Going farther back in time, Subaru automatics had D/3/2/1, ie they always had gear choices
This is a very important feature.
While some drivers might not use them frequently (or ever), drivers that are involved with the car's handling, acceleration, or performance have had the ability to fully control Subaru CVT or automatic transmissions. This is very important for safety, for acceleration, for passing and freeway merging, for snow control, for control going down hills without riding the brakes, for powering up hills, or just having fun.
There are paddle shifters on the 2014 Canadian 2.5 models except the base model (and it wasn't too long ago Canadians wanted US models).
If you think Subaru should put Paddle Shifters with manual control on the 2.5 models, please voice your opinion and concern to Subaru customer support at 800 SUBARU3 (800 782-2783)

It wasn't too long ago that Subaru proudly marketed its superior handling and performance capabilities as a distinctive benefit setting it apart from the Mediocrity of most other Japanese brands.
It was about being engaged with the car, and Subaru was more than just another bland modern car with a disconnected, driving experience.
This missing paddle shifter is a major down-grade for Subaru, and all the competitors (CRV, Rav, Santa Fe, Escape etc etc) have some form of transmission control more that the Low mode.
It essentially eliminates driver involvement. It makes the car much more generic (an appliance like a toaster over or microwave) and one of the only Crossovers without a driver controllable transmission.
The 2.5L's CVT 'Low mode' is effective for slower driving and hill descent in snow only but its not like the control one has using Paddle Shifters.
The 2.5 Limited and Touring models have new X-mode with hill descent control but that's not the same as the gear selectable Paddle Shifter.
The 2014 Forester 2.0XT has Paddle shifters, with either 6 or 8 sequentially selectable gears so Subaru knows that this is an important feature!
The driver of a 2.5L CVT also needs transmission control.
So this is the major disappointment on the long awaited Forester redesign.
Perhaps it's a cost savings but I hope not a sign of what is to come.
There are sure to be many buyers who looked forward to the 2014 Forester that will be frustrated by this omission.

Hopefully Subaru customer support (800 782-2783)  will hear about this from many people.

Here's my brief review
Overall, its a winner now and should continue to be for years.
A major upgrade and with a MSRP including destination starting at $22,820 and $23,820 for the CVT, the new Forester is a bargain.
They kept many of the popular features including the visibility (no blind spots), open spacious interior, easy to get in/out of, great cargo space, the over-sized moonroof....

Ride- quieter than previous versions. Slightly softer than the previous generation's firmer ride, the suspension is giving but not soft. The Outback is still one step softer.
Steering- the electric power steering is great, and this Forester turns on a dime!
Engine/transmission.
2.5L- The 2.5 engine is as good as it was last year and the year before. ,
The CVT is new in the Foresters and accelerates well, its zippy and and responsive, and as quiet as any transmission Subaru uses. The car rides and handles well and should be comfortable for both around town and open road driving. Rear visibility has been a hallmark of the Forester design and it continues to be excellent, so there are no big blind spots if the mirrors are correctly positioned.
Of course, readers will know how much I miss the Paddle Shifter on the 2.5L models and think Low mode is almost useless except for slowly going downhill in slippery conditions. New for 2014, xMode with Hill Descent (on Limited, Touring models) works at the very low speeds it was intended for and holds the car at the speed it was set at, and will be used in very similar slippery low speed situations as low mode.
2.0XT- zooooom... lots of power.. finally, a performance Forester!  Handles well with a little body lean but nothing scary.  Turbo lag is minimal (or is it the CVT) and not an issue for me though some reviewers will comment on it. SI drive is great, just like in the STI  (and other now deceased models). The all new high torque CVT takes this car forward at fine speed, a snap of the gas pedal and you're in ticket territory before you know it, even without the Paddle Shifters though they are needed for maximum performance and control. Yes, I miss the hood scoop- the air for the intercooler now goes from the upper grill through ducts attached to the underside of hood to the intercooler, which all seems too complex. Subaru engineers know what they are doing however, and wind-tunnel testing probably showed the hood scoop hurt MPG too much. The XT's front bumper's side 'gills' are fake which is too bad because they give the front of the XT a different, more aggressive look and would be even better looking if they actually did something. But its style, and Subaru has had fake scoops and air intakes on various models in the past, and currently does on the BRZ front fender, so this just follows in the family tradition. If you get an XT, be prepared to keep a light foot on the gas pedal to get decent MPG, and while you can use regular gas in the XT, premium gas is the better choice.

Dashboard- overall most controls are very easy to use and the instrument panel has large dials.  The upper console info-display is fun and brightly colored with good information but has a few repetitive MPG screens, and some of the setting functions are a bit complicated. Its not as hard as a TV/VCR though and its easy after a few tries. Most people will learn to access the information they use and won't bother with the rest. Also having the audio display on both the radio and on the upper info display is goofy but like the climate control on Limited and Touring models, once you know where to look, it isn't difficult to use. And really, some people will appreciate all the information.
Body- more stylish than the total rectangular simplicity of all previous Foresters, which were noted for their utility and lack of unnecessary adornment.  The 2014 is bigger, but it also looks bigger than it really is. It fits in the same parking spot as a 2013.  There is much more room inside. The driver seat should accommodate all but the very tallest people, and rear seat passengers and parents with child seats will all appreciate the extra rear seat legroom. The front passenger seat sits high and there's no height adjustment on the 14, so very tall passengers could be cramped on moonroof models. I expect the height adjustable passenger seat will return in the future. The doors open really wide so its very easy to get in and out of. Seniors will like that.
Features- power rear gate (Limited, Touring) is a nice feature that I could get certainly used to.
important note- the memory height control instructions are very complicated and require 4 pages in the owner's manual! Hopefully next year, there will be a simple knob with low, medium and high gate height settings.

I also like the new optional LED approach lighting/dimming outside mirror that replaces the puddle lights. Optional Eyesight/tech package with push-button start and HIDs/LEDs is new to the Forester and some people will appreciate it (optional on Touring model only).
Audio- HD radio is now standard on all models except the base 2.5.  If you like music, HD is the way to go, and its free.  The Harman Kardon (HK) audio, standard on Touring only, has great sound but its bundled with navigation which continues to have the same crowded screen with small buttons and stubborn voice activation system as previous years. Aha, also by HK, is a good addition to the navigation system. The navigation's radio definitely has good equalizers. The only way to get satellite radio is with navigation (its standard).
Keys- it might seem trivial, but the keys are now back to a standard cut, not the reverse laser cut of the past few years. That's a good thing for making a spare that will open the door (but not start the car, a chipped key is still required for that). Please don't lose all your keys since getting a new key when you don't have one will be expensive.

Missing
windshield upper tint band
rain sensing front wipers
height adjustable passenger seat
. its way too high.

On Towing a trailer with the 2014 Forester.
The 2014 is rated to tow up to 1500 pounds.  And even that would be a lot to tow behind the a 2.5L model because they have no transmission control or Paddle Shifters. Previous Foresters (2013, 2012, 2011 etc)  were rated at 2400 pounds.
The 2.0XT turbo model would be a better choice with its paddle shifters, though the turbo engine would be boosted most of the time when towing which isn't particularly desirable.
The lack of paddle shifters on the 2.5s of course means the Forester is a not a good choice for anything other than infrequent, light towing. People who tow, know that transmission control is key to their safety and vehicle performance - whether slowing on a downgrade, pulling up a hill, or pulling a boat up a steep ramp for example.  In a side wind or bumpy road with the trailer swaying, the experienced tower doesn't want to just hit the brakes, instead they know to gradually downshift to maintain stability and safely control the trailer and vehicle. The computer managed Low mode is the only choice the driver has other than Drive, and Low mode simply doesn't give the driver any transmission choices.

X-mode h
as to be activated under 12mph, and cuts off over 25mph.
X-mode is a low speed system activated by the driver. It's a computerized management system that controls the engine, CVT transmission, AWD system, brakes, and VDC to help maintain control on slippery surfaces or steep hills. Its combined with hill descent, and only works at low speeds.
Hill descent control is activated with X-mode and uses VDC engine throttle management and brakes to help maintain vehicle speed when going downhill at low speed. When activated, the system will maintain the speed it was set at.

VDC (vehicle dynamics control) stability control system with Traction Control System (TCS)

Standard on all models
VDC (vehicle dynamics control) is a
full time, all wheel, all speed electronic stability control with TCS traction control with 'off' button
VDC is a electronic stability skid control system that measures and monitors steering wheel input, braking, vehicle angle etc and then applies individual brakes and/or reduces engine power to counteract skids or slides to help keep maintain driver control. Is an integral part of Xmode/hill descent on Limited/Touring models
TCS Traction Control System. TCS senses spinning wheels and applies the brakes to maintain traction.

In addition to the vehicle manufacturer (Subaru), other parties such as law enforcement that have the equipment can read the information if they have access to the vehicle or EDR.  Existing laws generally provide that information in an EDR is confidential and is the property of the owner of the motor vehicle.
